We provide this Privacy Policy to inform users of our policies and procedures regarding the collection, use and disclosure of personal information received from users of our website, services applications, software or other means. This Privacy Policy may be updated from time to time for any reason, at Developmate’s sole discretion. We will notify you of any substantive changes to our Privacy Policy by posting the new Privacy Policy on our website. You are advised to consult this Privacy Policy regularly for any changes. By using or accessing Developmate products or services, you are accepting the practices described in this Privacy Policy, and you are consenting to our processing of your information as set forth in this Privacy Policy now and as amended by us.
I. Information You Give Us
a. This Privacy Policy applies to Developmate products, services and our website (“Software Services”).
b. Developmate collects information from individuals who visit Developmate’s website (“Visitors”) and individuals who register to use the Software Services (“Clients”) either individually or on behalf of an entity. Developmate may also collect information about how you use the Software Services, such as activity data, feature usage and product version data. This information may be aggregated or identifiable. Developmate may collect data to improve our operations and to understand how to provide you with the best experience.
c. When expressing an interest in obtaining additional information about the Software Services or registering to use the Software Services, Developmate may require you to provide it with personal contact information, such as name, company name, address, phone number, and email address. When purchasing the Software Services, Developmate may require you to provide it with billing information, such as billing name and address, credit card number, and the number of employees within the company that will be using the Software Services. Developmate may also ask you to provide additional information, such as company annual revenues, number of employees or industry. This information, e.g., contact, billing and optional information, will be referred to collectively as “Data About Developmate Clients.” As you navigate Developmate’s Website, Developmate may also collect information through the use of commonly-used information-gathering tools, such as cookies and web beacons (“Website Navigational Information”). Website Navigational Information includes standard information from your web browser (e.g., browser type and language), your internet protocol (“IP”) address, and the actions you take on Developmate’s website (e.g., the web pages viewed and the links clicked). II. Use of Information Collected
a. Our Software Services are designed for businesses and are not intended for personal or household use. Accordingly, we treat all data covered by this Privacy Policy, including information about any visitors to our website, as pertaining to individuals acting as business representatives, rather than in their personal capacity.
b. Developmate uses Data About Developmate Clients to perform the Software Services requested. When you purchase the Software Services or provide Developmate with personal information, a unique identifier is assigned to you. Each time you log into the Software Services, Website Navigational Information is used to allow Developmate to uniquely identify you when you are logged into the Software Services and to process your online transactions and requests.
c. Developmate may also use Data About Developmate Clients, possibly in connection with Website Navigational Information, for marketing purposes. For example, Developmate may use information you provide to contact you to further discuss your interest in the Software Services and send you information about Developmate, any of its partners, e.g., information about promotions or events. Developmate may, for example, use Website Navigational Information in marketing emails that notify Developmate when you click on a link in the email that directs you to Developmate’s website.
d. Developmate uses billing information, e.g., credit card information, solely to check the financial qualifications of prospective Clients and to collect payment for the Software Services.
e. Developmate uses Website Navigational Information to operate and improve Developmate’s website and email communications, e.g., to make interactions with Developmate easy and meaningful. Developmate may use Website Navigational Information to compile information about Clients and Visitors’ usage of the website and interaction with emails from Developmate.
f. Developmate may also use Website Navigational Information alone or in connection with Data About Developmate Clients to store and provide personalized information about Developmate to you. Developmate may also use Website Navigational Information to track and aggregate non-personal information, e.g., Developmate may use IP addresses to monitor the regions of the country from which Clients and Visitors navigate Developmate’s website.
g. Unless you choose to identify yourself to Developmate, either by responding to a promotional offer, opening an account, or filling out a web form, you remain anonymous to Developmate. If you choose to identify yourself to Developmate, Developmate may use Website Navigational Information to allow Developmate to uniquely identify you. You may refuse to accept certain Website Navigational Information, e.g., certain cookies, by activating the setting on your browser which allows you to refuse the setting of cookies. If you disable your web browser’s ability to accept certain Website Navigational Information, you will be able to access Developmate’s website; however, you may not be able to successfully access and use the Software Services.
h. Developmate may engage third parties to track and analyze usage and volume statistical information from individuals who visit Developmate’s website. Developmate may use third-party providers to help us provide the Software Services. In order to gain useful insights, these analytics providers may set tracking technologies (e.g., cookies) to collect information about your use of the Software Services and across other websites and online services. Developmate may also use third-party Website Navigational Information to track performance of Developmate advertisements. The information provided to third parties does not include personal information, but this information may be reassociated with personal information after Developmate receives it. Developmate may also contract with third-party advertising networks that collect Website Navigational Information on the website, emails and third-party websites. Ad networks may follow your online activities over time by collecting Website Navigational Information through automated means. They use this information to provide advertisements about products and services tailored to your interests. You may see these advertisements on other websites. This process helps Developmate manage and track the effectiveness of our marketing efforts.
i. Developmate may provide bulletin boards, blogs, chat rooms or other forums on the website. Any personal information you choose to submit in such a forum may be read, collected, or used by others who visit these forums, and may be used to send you unsolicited messages. Developmate is not responsible for the personal information you choose to submit in these forums. Clients and Visitors may elect to refer friends about Developmate’s website. When making referrals, Developmate may request the friend’s name and email address. Developmate will automatically send the friend a one-time email inviting them to visit Developmate’s website. Developmate does not store this information. Developmate may post a list of Clients and testimonials on Developmate’s website that contain information such as Client names and titles. Developmate obtains the consent of each Client prior to posting any information on such a list or posting testimonials.
III. Sharing of Information Collected
a. Developmate may share Data About Developmate Clients with Developmate’s service providers so the service providers may contact Clients and Visitors who have provided contact information on our behalf. Developmate may also share Data About Developmate Clients with Developmate’s service providers to ensure the quality of information provided. Unless described in this Privacy Policy, Developmate does not share, sell, rent or trade any information provided with third parties for their promotional purposes. From time to time, Developmate may partner with other companies to jointly offer products and services. If you purchase or specifically express interest in a jointly-offered product or service from Developmate, we may share Data About Developmate Clients collected in connection with your purchase or expression of interest with our joint promotion partners, once Developmate has notified you of the information to be shared and obtained your consent to the sharing of the information. Developmate does not control our business partners’ use of the Data About Developmate Clients we collect, and their use of the information will be in accordance with their own privacy policies.
b. Developmate may use third-party service providers to manage credit card processing. Such service providers will not be permitted to store, retain, or use billing information except for the sole purpose of credit card processing on Developmate’s behalf.
c. Developmate reserves the right to use or disclose information provided if required by law or if Developmate reasonably believes that use or disclosure is necessary to protect Developmate’s rights and/or to comply with a judicial proceeding, court order, or legal process.
d. As Developmate develops its business, it may buy or sell assets or business offerings. Data About Developmate Clients is generally one of the transferred business assets in these types of transactions. Developmate may also transfer such information in the course of a corporate divestiture, merger or dissolution.
IV. Security
a. Developmate uses appropriate administrative, technical and physical security measures to protect Data About Developmate Clients. However, we cannot guarantee that hackers or unauthorized personnel will not gain access to your personal information despite our efforts.
b. You should note that in using Developmate’s website and Software Services, your information may travel through third-party infrastructures, which are not under our control.
c. We cannot protect, nor does this Privacy Policy apply to any information you transmit to other users of the website or Software Services. You should never transmit personal or identifying information to other users.
d. Developmate and its Software Services are based in the U.S. By using Developmate’s website, participating in any of the Software Services, or by providing Developmate with your information, you consent to the collection, transfer, storage, and processing of information in the U.S. Developmate will take all steps reasonably necessary to ensure that your data is treated securely in accordance with this Privacy Policy.
V. Communications Preferences and Contacting Us
a. Developmate offers Clients and Visitors who provide contact information a means to choose how Developmate uses the information provided. You may manage your receipt of marketing and non-transactional communications by contacting us at support@developmate.io.
b. Clients may view, update or change their registration information by logging in to their accounts. Requests to access, change, or delete your information will be handled within ten (10) business days.
c. You may access your specific personal information, details about our processing of your personal information and have the right to delete your information. Moreover, you may designate, in writing or through a power of attorney, an authorized agent to make requests regarding your personally identifiable information on your behalf. Before accepting such a request from an agent, we will require you to provide proof you have authorized it to act on your behalf, and we may need you to verify your identity directly with us. To provide or delete specific pieces of personal information we will need to verify your identity to the degree of certainty required by law.
